The WOHVA OHV Awareness Rally is next Friday, March 9th on the Capital Steps in Olympia.  The flyer for the rally is at www.WOHVA.org.  The speakers begin at 12:00noon.  If you don't think we need your support read the information below.  This is real folks.... this is what we are up against.  We need the largest showing ever next Friday and you can make a difference.  Two years ago the freeways were backed up from OHV users coming to the rally, we need to do that again.  There will be parking on Duchutes Parkway with a bus running back and forth.  If you go to the bottom of the email you will see the original letter and then above it is the response from Sen. I signed on because I have been annoyed, endangered, and angered one too
many times by people riding motorized dirt-bikes and other off-road vehicles
that have no damn business anywhere.  To me, this bill is narrow--it doesn't
include those "personal watercraft," seemingly jet-powered little missiles
whose only apparent purpose is to risk death and dismemberment for boaters
and swimmers, for the amusement of spoiled drunk teenagers.

Yes, I am sure there is the occasional responsible person who rides one of
these machines on land or water.  And yes, like every human being I have
been pleasantly surprized to find my stereotypes broken.  But why, why, why,
do folks insist on motorized "sports"?  Those two words are an oxymoron.
There is nothing sporting--athletic, physically demanding--about riding any
machine anywhere.  And it's a damned annoyance to folks who see the outdoors
as a place to go for quiet and solitude and self-exploration.  I would be
happy to ban the use of the internal combustion engine off-road, by anyone
without a handicapped sticker, subject to a stiff fine.  Maybe we could call
this an anti-obesity measure.

Please circulate this to all motorized sports enthusiasts, so they can
remember never to vote for me.

I am curious to know why you would co-sponsor the most discriminatory,
anti-OHV Bill ever proposed?

SB 5544changes would creating maximum sound levels for riding
near any residence, regardless of where that residence is located or how it
is zoned.  It would become illegal for my Family to ride our motorcylces and
quads
where they are "plainly audible" from in or adjacent to any residence.  This
would even include residences that are on farm land, forest land or in an
industrial area.

One of the few riding area riding areas where it is still legal to ride in
Western Washington is Captial State Forest near Olympia. There are a few
parcels of private property located within the forest. This law, if passed,
would effectively shut this area down. Ditto for the nearby Straddle Line
ORV park.

What really strikes me as absurd about this proposal is race tracks like
Evergreen Speedway in Monroe could host auto races of all types, but any off
road events would be illegal.

In addition, this law would only apply to my dirtbike or quad.  It would not

apply to other, more common sources of residential noise such as lawnmowers,

chainsaws, cars, trucks, boats, airplanes, stereos, playgrounds, ballfields,

etc.  It is just plain discrimination against Off Highway Vehicle use and
has nothing to do
with keeping neighborhoods quiet.

Off Highway Vehicle recreation is a fun and growing family sport, it would
be nice to see sports that support families embraced by Olympia with more
open riding areas, instead of discriminated against.

I would hope that you drop your support of this legislation.

A bill in the Washington State Legislature known as SB 5544, if adopted as written, could all but eliminate motorcycle and ATV use on public and private property throughout much of the state. It includes a never before seen standard against "clearly audible" sound levels for all OHV noise, something that is simply impossible to meet.

This bill which had been stalled in the consumer protection committee was recently passed (on Friday the 23rd) and is headed to the senate rules committee. Go to http://apps.leg.wa.gov/billinfo/for the most current bill language.

The latest version included some reasonable modifications, including a limitation on pipe dB's of 96 using the J-1287 test procedure, something supported by BRC and AMA, but kept the "clearly audible" standard in place, along with a cost recovery provision for lawsuits, something that cannot be allowed to stand.

The Washington State Legislature is currently considering drastic changes to the offroad vehicle noise laws.
 
The proposed changes would include creating maximum sound levels for riding near any residence, regardless of where that residence is located or how it is zoned. It would become illegal to ride if your bike is either plainly audible or exceeds 45 decibels from inside of, or with 10 feet of any residence. This would even include residences that are on farm land, forest land or in an industrial area. It would also be illegal to ride if your bike exceeds 55 decibels at the property line. The fine for this new crime would be a minimum of $100, going up to a maximum of $800.
 
These new limits would only apply to your dirtbike or quad. It would not apply to other, more common sources of residential noise such as lawnmowers, chainsaws, cars, trucks, boats, airplanes, stereos, playgrounds, ball fields, etc. It is just plain discrimination against ORV use and has nothing to do with keeping neighborhoods quiet.
 
If this becomes law, forget about riding any track in the State of Washington. Also, you can count on the vast majority of riding areas shutting down.

I sent this letter out to US Representative  Norm Dicks, US Senator Maria Cantwell, Us Senator Patty Murry, Senator Rosa Franklin, Representative Steve Conway, and Representative Steve Kirby.

Cut and  Paste if you like or send your own. Writing letters really helps if they get more than a few and request a response.

I am not happy with this Bill. I have been a Active 4 wheeler for 15 years . I take my kids out all the time. We spend time in the woods fixing trails and taking care of environmental issues. I was the coordinator for Elbe Hills ORV park for 8 years. My kids like being with there mom and dad. they are not on the streets doing drugs and running a muck.
We now organize 4 wheel drive events at Straddleline ORV Park. We are non profit and donate the money to help the community. My friends and family. Really have good Values. If this Bill passes it will crush us and end everything we and thousands of other people are about. this is ridiculous that we half to fight to keep crap like this from passing. You would think that a little common sense would apply to some of these bills. Next it will be tractors, and lawn mowers and weed eaters and radios  and chain saws all these items are over 96 decibels. Some day we won't have any rights left. Do me a favor and let me know where you stand on this Bill, I need to figure out who has the common sense in our government so I can decide on how I want to vote and how I will want to influence others to Vote.

Thank you for your message.  While I recognize growing concerns from
the community of Off Road Vehicle (ORV) enthusiasts, I believe we agree
that these vehicles ought to comply with reasonable regulation.

Versions of the bill were introduced in both the House and Senate.
February 28th was the deadline for bills to be voted out of the first
committee they were referred to.  The House version, HB 1434, was not
acted on by the committee, so it will not be considered further; it's
dead.  The Senate version, SB 5544, was amended in the Senate Committee
clarify that the tail pipe noise levels of 96 decibels only applies to
model year 2008 and beyond. Existing vehicles will be measured against
the current standard, which is 105 decibels at 20 inches.  This amended
version was voted out of committee and is now in the Senate Rules
Committee where it might advance to the Senate Floor for a vote, which
would have to occur by March 14.  If the Senate passes the bill, it
will
come to the House and be referred to committee. Not serving on that
committee, it will be about a month before the bill might possibly come
before me on the House Floor for consideration.  I'd welcome comment
from you on the bill as amended should it come to the House for further
consideration.  The whole goal should not be a strategy to prohibit ORV
use, but rather one to encourage responsible, considerate use.
